Terms of Service

By using the Pokemon Card Scanner website (pokemoncardscanner.com) or our iOS application (collectively, “the Service”), you agree to these Terms of Service. If you do not agree to these terms, please do not use the Service.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, in accordance with these terms and any applicable platform terms (such as Apple's standard App Store Terms of Service for the iOS app).

2. Permitted Use

You agree NOT to:

• Resell, redistribute, sublicense, or rent the Service
• Reverse engineer, decompile, or disassemble the Service
• Use the Service for any unlawful purpose or in violation of any local, state, national, or international law
• Attempt to bypass rate limits, anti-scraping protections, or other technical measures
• Use automated means (bots, scrapers) to extract data from our services
• Use the Service in a manner that interferes with other users' access

3. In-App Purchases and Subscriptions

The iOS app may offer optional in-app purchases or subscriptions for premium features. All purchases are processed through Apple's App Store and are subject to Apple's standard terms.

If you subscribe:

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours of the end of the current period
• You can manage and cancel subscriptions through your Apple ID account settings on your device

Any unused portion of a free trial period is forfeited when you purchase a subscription.

4. Card Data and Pricing Accuracy

The Service aggregates pricing and metadata from third-party sources including pokemontcg.io and publicly available eBay sales data.

Prices displayed are estimates based on recent market activity and are not guarantees of value. Card prices fluctuate continuously, and factors such as condition, edition, and authenticity affect real-world trading prices. Always verify pricing from authoritative sources before buying or selling cards.

We do not warrant that the price data is complete, accurate, current, or free of errors.

5. No Affiliation with The Pokémon Company

Pokemon Card Scanner is an independent, unofficial reference application for trading card enthusiasts.

Pokémon, the Poké Ball, and Pokémon Trading Cards are registered trademarks of Nintendo, Creatures Inc., and GAME FREAK Inc. All Pokémon imagery shown is the copyrighted property of its respective owners.

Pokemon Card Scanner is not produced, supported, endorsed, or associated with The Pokémon Company International, Inc., Nintendo, Creatures Inc., or GAME FREAK Inc.

6. User Content

If you create binders, lists, notes, or other content within the iOS app, that content is stored on your device. We do not claim ownership of your content.

We are not responsible for backing up your content. If you delete the app, reset your device, or experience data loss, your binders and saved cards may not be recoverable.

7. Third-Party Services and Links

The Service relies on third-party services (such as pokemontcg.io and Google Gemini for fallback identification) and may link to external sites (such as eBay listings). We are not responsible for the availability, content, or practices of these third-party services. Your use of them is governed by their own terms.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected, nor that the Service will be free from viruses or other harmful components.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:

• Loss of profits, revenue, data, or other intangible losses
• Errors or inaccuracies in card pricing or identification
• Inability to access or use the Service
• Cost of substitute services

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, the Service, or third parties.

You may stop using the Service at any time by uninstalling the iOS app or ceasing to use the website.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will post any changes on this page and update the “Last updated” date above. Your continued use of the Service after changes are posted constitutes your acceptance of the new terms.

12. Governing Law

These Terms of Service are governed by the laws of the jurisdiction in which the Service's operator is established, without regard to conflict of law principles. Any dispute arising from these terms shall be resolved in the courts of that jurisdiction.
